Protection of Personal Data under the LOPD and GDPR

Bend It Sports, S.L., in application of the current regulations on the protection of personal data, informs that the personal data collected through the forms of the Bend It platform (“Platform”) are included in specific automated files for users of Bend It’s services.

The collection and automated processing of personal data are carried out for the purpose of maintaining the business relationship and performing information, training, advisory tasks, and other activities inherent to Bend It.

These data will only be transferred to those entities where it is necessary with the sole purpose of fulfilling the previously stated objectives.

Bend It adopts the necessary measures to guarantee the security, integrity, and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

The User may, at any time, exercise the rights of access, rectification, restriction of processing, deletion (right to be forgotten), data portability, and objection, as well as the right to withdraw previously granted consent, as recognized in Articles 15 to 22 of the GDPR.

The exercise of these rights may be carried out by the User by sending us an email at info@bendit.app, through the “Contact” section, or at the address Calle Llull (Sant Martí), 321, 08019 Barcelona, Spain.

The User declares that all the data provided by them are true and correct, and undertakes to keep them updated, informing Bend It of any changes.

Principles Applied in the Processing of Personal Data

In handling your personal data, Bend It will follow the following principles, in accordance with the requirements of the GDPR and the LOPD:
  • Principle of lawfulness, fairness, and transparency: We will always require your consent for the processing of your personal data, previously informing you in a transparent manner about the specific purposes.
  • Principle of data minimization: We will only request the data strictly necessary for the specified purposes.
  • Principle of storage limitation: We will retain the data only for as long as necessary for the purposes of the processing. In the case of subscriptions, we will periodically review the lists and remove inactive records.
  • Principle of integrity and confidentiality: We will process your data securely, ensuring its confidentiality and integrity. We take precautions to prevent unauthorized access or misuse of the data by third parties.

Purpose of the processing of personal data

For what purpose will we process your personal data?

At Bend It, we will process the personal data collected through the Platform for the following purposes:

  1. If you contract the goods and services offered through the Platform, to maintain the contractual relationship, as well as to manage, administer, inform about, provide, and improve the service.

  2. To carry out market studies and statistical analyses in order to improve the product and the service.

  3. To send information requested through the forms provided on the Platform.

  4. To send newsletters and commercial communications regarding Bend It promotions and/or advertising and sector-related information.

Please remember that you may object to receiving commercial communications by any means and at any time by sending an email to: info@bendit.app.

For how long are the personal data collected retained?

The personal data provided will be retained as long as the business relationship is maintained or until you request its deletion, and for the period during which legal liabilities could arise from the services provided.

Legal Basis

The processing of your data is carried out on the following legal bases that legitimize it:

  1. The request for information and/or the contracting of Bend It’s services, whose terms and conditions will be made available to you in any case, prior to a possible contract.

  2. Your free, specific, informed, and unequivocal consent, as we inform you by making this privacy policy available to you, which, after reading it, you may accept if you agree, through a declaration or a clear affirmative action, such as ticking a checkbox provided for that purpose.

If you do not provide us with your data, or if you provide it incorrectly or incompletely, we will not be able to process your request, making it entirely impossible to provide you with the requested information or to carry out the contracting of the services.

Recipients

The data will not be disclosed to any third party outside of Bend It, except where there is a legal obligation or when it is necessary for the provision of services by third parties.

To ensure the operation and development of our platform, we share personal data with external service providers, including the company responsible for developing the platform. All data and processing operations are carried out within the territory of the EU, or are based on an EU adequacy decision under Article 45 GDPR.

These providers are committed to complying with the applicable regulatory provisions on data protection at the time of their engagement, and we have signed the corresponding data processing agreement with them to guarantee the security and confidentiality of the data.

Data Collected by Users of the Services

In cases where the user includes files containing personal data on shared hosting servers, Bend It shall not be held responsible for the user’s non-compliance with the LOPD and GDPR.

Data Retention in Compliance with the LSSI

Bend It informs that, as a data hosting service provider and pursuant to the provisions of Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSI), it retains, for a maximum period of 12 months, the essential information needed to identify the origin of the hosted data and the moment when the provision of the service began.

The retention of this data does not affect the confidentiality of communications and may only be used within the framework of a criminal investigation or for the protection of public safety, being made available to judges and/or courts or to the relevant Ministry that may so require.

User Geolocation

Bend It collects user geolocation data with the aim of improving talent search on the platform. This information is used to provide more accurate and personalized search results, as well as to enhance the overall user experience. The collection of this data is carried out only with the user’s consent, who has the option to accept or deny this feature at any time.

Advertising on Social Media

As part of its marketing and promotion strategies, Bend It selects featured user profiles to be published on its social media channels such as Instagram, LinkedIn, and TikTok. This activity aims to increase user visibility on these platforms and attract new users to the Bend It platform. The user profile information shared on these social media channels is subject to the user’s consent. It is important to note that users have control over whether they want their profile to be promoted in this way and may withdraw their consent at any time.

Intellectual Property Rights

Bend It holds all copyright, intellectual property, industrial property, “know-how,” and any other rights related to the contents of the Platform and the services offered therein, as well as the programs necessary for its implementation and the related information.

The reproduction, publication, and/or use—other than strictly private use—of the Platform’s contents, in whole or in part, is not permitted without prior written consent.

Intellectual Property of the Software

The User must respect third-party programs made available by Bend It, even if they are free and/or publicly accessible. Bend It holds the necessary exploitation and intellectual property rights over the software.

The User does not acquire any rights or licenses, through the contracted service, over the software necessary for the provision of the service, nor over the technical information for monitoring the service, except for the rights and licenses necessary for the fulfillment of the contracted services, and only for the duration of such services.

For any action that goes beyond the scope of the contract, the User will need prior written authorization from Bend It®. The User is strictly prohibited from accessing, modifying, or viewing the configuration, structure, and files of the servers owned by Bend It®. The User assumes civil and criminal liability for any incident that may occur in the servers and security systems as a direct consequence of negligent or malicious actions on their part.

Intellectual Property of Hosted Content

The use of Bend It’s services in a manner contrary to intellectual property law (Royal Legislative Decree 1/1996 of April 12, which approves the consolidated text of the Intellectual Property Law) is strictly prohibited, and in particular:

  • Any use that is contrary to Spanish intellectual property laws.

  • The publication or transmission of any content that, in Bend It’s judgment, is violent, obscene, abusive, illegal, racist, xenophobic, or defamatory.

  • Any type of content that infringes third-party intellectual property rights.

  • The collection and/or use of personal data of other users without their express consent or in violation of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

  • The use of the Platform itself for sending unsolicited bulk email (spam).

The User is fully responsible for their content on the Platform, the information transmitted and stored, hyperlinks, third-party claims, and legal actions related to intellectual property.

Third-Party Rights and Protection of Minors

The User is responsible for complying with the laws and regulations in force, as previously mentioned, as well as the rules relating to the operation of online services, electronic commerce, copyright, maintenance of public order, and universal principles of Internet use.

The User shall indemnify Bend It for any expenses arising from Bend It being implicated in any matter attributable to the User, including legal defense fees and costs, even in the event of a non-final judicial decision.

Protection of Hosted Information

Bend It makes backup copies of the content hosted on its servers; however, it is not responsible for the loss or accidental deletion of data by Users. Likewise, it does not guarantee the complete restoration of data deleted by Users, as such data may have been deleted and/or modified during the period elapsed since the last backup.

Commercial Communications

In application of the LSSI, Bend It will not send advertising or promotional communications by email or other equivalent electronic means unless they have been previously requested or expressly authorized by the recipients.

In the case of Users with whom there is a prior contractual relationship, Bend It is authorized to send commercial communications regarding Bend It products or services that are similar to those initially contracted with the customer.

In any case, the User, after verifying their identity, may request to stop receiving further commercial information through Customer Service channels.
